Meeting was called to order by Supervisor Knox at 7:04 pm.


Resolution #1: Rules of Procedures

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to adopt Parliamentary Law as defined by Robert’s Rules of Order, as the rules of procedure, with the following adaptions:

A. New York State Law supercedes parliamentary law a conflict between New York State law will be resolved in favor of New York state Law.

B. Time limit per speaker shall be five minutes per speech unless previously changed for a particular item or motion at the beginning of debating the item or motion.

C. Any citizen of the Town of Russell may participate in the debate of an agenda or item motion which has been introduced and seconded by elected members of the board, and accepted by the Supervisor/Chairman. Citizens participating in the debate are subject to these rules of procedures, except they may not second or vote on an amendment or other question put to vote.

Resolution #2: Official Newspapers

A motion was made by Supervisor Knox and seconded by Councilwoman Foster naming the St. Lawrence Plaindealer and the Watertown Times as the official newspapers papers for the Town of Russell for the year 2009.

Resolution #3: Dog Control Officer

A motion was made by Councilman Whiteford and seconded by Supervisor Knox appointing Jack White as the Dog Control Officer for the year 2009.

Resolution #4: Code Enforcement Officer Contract

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to allow the supervisor to sign a contract with Alton (Ike) Guyette as the Code Enforcement Officer for the Town of Russell at the salary of $7,452 for the year 2009.

Resolution #5: Regular Meetings

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to hold the regular Board Meetings on the third Wednesday of each month at 7:00 pm.

Resolution #6: Bank Depository

A motion was made by Councilman Whiteford and seconded by Councilwoman Foster naming the depository for the Supervisor the NBT Bank and the Community Bank in Hermon as the depository for the Town clerk/Tax Collector for the year 2009.

Resolution #7: Insurance Carrier

A motion was made by Supervisor Knox and seconded by Councilman Whiteford naming Selective Insurance through Rose & Keirnan Insurance Company as the Town’s Insurance Company for the year 2009

Resolution #8: Registrar of Vital records

A motion was made by Councilman Whiteford and seconded by Councilwoman Foster to appoint Tess Eells as the Registrar of Vital Statistics for the year 2009.

Resolution #9: Second Notices

A motion was made by Councilman Whiteford and seconded by Councilwoman Foster to make the following resolution:

WHEREAS, section 987 of the Real Property Law provides for the Tax Collector to mail a second notice to each owner of real property upon which taxes remain unpaid on the currant tax roll to which his or her warrant relates to, and
WHEREAS, the governing body of the Town of Russell may adopt by resolution providing for the expense of mailing out such notice with an additional penalty of not more than $2.00 chargeable against such parcel,
THEREFORE, the Town of Russell approves the penalty of $1.00 to be charged against each parcel requiring the second notice.

A motion was made by Councilwoman Foster and seconded by Councilman Whiteford to set the mileage at .45 cents per mile for the year 2009.

A motion was made by Councilman Whiteford and seconded by Supervisor Knox to set the salaries of all elected officials as follows:

Board members (each): $1,446.00

Resolution #12: Cemetery Contracts

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to allow the supervisor to sign the cemetery contracts with the North Russell and South Russell Cemeteries, in the amount of $500.00 each for the purpose of the up keep on the veteran’s graves for the year 2009.

Resolution #13: Dog Facility Contract

A motion was made by Councilman Whiteford and seconded by Councilwoman Coller to authorize the supervisor to enter in to a contract with Jack White for the care of strays and abandoned dogs found by Jack White as part of the duties as dog control officer, which is separate from dog control officer. The Town of Russell shall pay Jack White $ 1,800.00 for the care of strays and abandoned dogs for the Town of Russell for the year 2009.

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to authorize the supervisor to enter into a senior’s contract in the amount of $1,200.00 for the year 2009.

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to authorize the supervisor to enter into a contract with the Edwards-Knox Central School for the summer program for the year 2009 in the amount of $1,500.00

A motion was made by Councilman Whiteford and seconded by Councilwoman Coller to authorize the supervisor to enter into a contract with North Country Life Flight Inc. for the year 2009 in the amount of $150.00 to be taken from account #A3989.4 for LIFE FLIGHT.

A motion was made by Supervisor Knox and seconded by Councilwoman Foster to authorize the supervisor to enter into a contract with the Russell Public Library in the amount of $15,500.00 for the year 2009.

Resolution #18: Adopt a Senior Citizen Exemption

A motion was made by Supervisor Knox and seconded by Councilman Whiteford to leave the senior citizens exemption at $10,000.00 - 15,700.00 sliding scales of 20% for the year 2009 assessment rolls.

Resolution #19: Compensation for Board of Assessment Review

A motion was made by Supervisor Knox and seconded by Councilwoman Coller to set the compensation rate for the assessment review board for the year 2009.

Misc. reimbursed expenses of .45@ mile for mileage.

Deputy Town Clerk/Collector of Taxes/Registrar: Tess Eells the Town Clerk will appoint Bonnie Howard as her Deputy Clerk and Sub-Registrar / Collector and Jennifer Clary as a clerk.


Resolution #20: Appropriating money for Clerks new computer

A motion was made by Supervisor Knox and seconded by Councilwoman Foster to increase the Clerk’s 2008 contractual from the Fund Balance for $998.00 for the cost of her new computer and decrease the 2009 Equipment fund account by $998.00 for the cost of the new computer and put it back in the Fund Balance.

Resolution #21:

A motion was made by Supervisor Knox and seconded by Councilwoman Coller to implement a 15% decrease in all contractual accounts in the General and Capital Improvement and a 5% decrease in the highway contractual. But if the town gets the money expected from state funding the money will be re-appropriated back into the contractual one at a time or all at once when necessary. The decreases are because the town is not sure of the state funding we will receive.

A motion was made by Councilman Whiteford and seconded by Councilwoman Coller to allow Dick Knox to purchase a new cordless drill to replace the one he used doing volunteer work on the new Library/Museum; and the old one will be property of the town for the maintenance man to use.

Resolution #23: Sick Time for Carmen Ashlaw

A motion was made by Supervisor Knox and seconded by Councilwoman Coller to give Carmen Ashlaw the Town maintenance man 1 sick time hour per pay period starting the first pay period in January 2009.

Supervisor Knox stated that he found out on 12/23 that the town was eligible to apply for a stimulus package. Fred Morrill did not inform the town about it. We sent Fred Morrill a list of projects we would like done.


A motion was made to adjourn the meeting at 8:50pm all were in favor.
